Kluwer Arbitration Post: “Bosnia and Herzegovina: Arbitral Awards Reviewed under the Courts’ ‘Magnifying Glass'”
Patricia Zivkovic, Assistant Editor for Europe, recently analysed a decision of a BiH court that set aside an arbitration award of the Arbitration Court attached to the BiH Foreign Chamber of Commerce. Defendant from the arbitration proceeding sought annulment of the arbitration award on the basis of violation of due process. BiH court accepted this argument, and set aside the award. According to the author, arguments of the plaintiff and reasoning of the court were treated rather as an appeal rather than limited review of the proceedings.
